What is VA Income Tax



The State of Virginia levies an income tax on all income earned by Virginia residents, whether actual or legal residents, or Virginia Income earned by non-residents or part-year residents. The tax is based on the Federal Adjusted Gross Income.

In most cases, your federal adjusted gross income (line 21 on form 1040A; and line 37 on form 1040) plus any Virginia additions and minus any Virginia subtractions computed on Schedule ADJ, is called Virginia Adjusted Gross Income. It does not include standard or itemized deductions, the child and dependent care expense deduction, or personal exemptions. See the Virginia Resident Individual Income Tax Booklet, or call our office for details. Except for Part-Year residents, Virginia Adjusted Gross Income does NOT exclude income from outside of Virginia.

Who Must File VA State Income Tax



If your Virginia Adjusted Gross Income (VAGI) is under the amounts listed according to your filing status below; you do not have to file a Virginia return, except to receive a refund of any Virginia Income tax withheld.

You must file if you are:

  • Single and your VAGI is $11,950 or more
  • Married filing jointly and your combined VAGI is $23,900 or more
  • Married filing separately and your VAGI is $11,950 or more

To determine Virginia Adjusted Gross Income (VAGI) complete lines 1 through 9 of the Virginia State Tax Form 760. If the amount on line 9 is less than the amount shown above for your filing status, your Virginia income tax is -0- and you are entitled to a refund of any withholding or estimated tax paid. You must file a return to receive a refund.

To claim a refund in these cases:

Skip to line 16 and enter -0- as your tax then
Complete lines 17 - 28.

If the amount on line 9 is more than the amount shown above for your filing status, complete lines 10 through 15, calculate your Virginia Income Tax according to the tax tables on page 33 through 41 and record it on line 16. Compute Spouse Tax Adjustment according to worksheet on page 14 of the instructions and subtract computed amount from line 15 in order to determine tax liability (line 18). Compute lines 19 through 28 to determine whether enough tax has been withheld or paid in quarterly as estimates. If you owe additional taxes record that amount on line 32. If you are receiving a refund record that amount on line 36.

Be sure to attach the required documentation to the return, you and your spouse (if appropriate) must sign and date the return.

Electronic Filing, or e-file for short, is used to electronically prepare and file your IRS and State tax return over the Internet. There are several commercial tax preparation software companies that participate as an e-file provider. Most of these software companies have websites that provide taxpayers with on-line options for completing and filing returns electronically and many taxpayers qualify for FREE e-file. Important Tips & Reminders:

  • Use Black Ink for hand printed Returns (do not use pencil please)
  • Refunds for electronically filed returns typically are issued in about 1 week
  • Refunds for paper returns typically take about 4 weeks from the date received in Richmond
  • If a paper check is requested add an additional week to the wait time

Per the Virginia Tax website:

Individual Income Tax Filing Due Dates

  • Per the Virginia Tax website:  Typically, most people must file their tax return by May 1. However, the filing deadline for 2020 individual income tax returns has been extended to Monday, May 17, 2021. For more information about filing your return this year, see Avoid Pandemic Paper Delays: Tips for Filing Season. 
  • Fiscal year filers: Returns are due the 15th day of the 4th month after the close of your fiscal year.

If the due date falls on a Saturday, Sunday, or holiday, you have until the next business day to file with no penalty.

Filing Extensions

Can’t file by the deadline? Virginia allows an automatic 6-month extension to file your return (Nov. 1 for most people). No application is required. You still need to pay any taxes owed on time to avoid additional penalties and interest. Make an extension payment.

  • If you live in another state but worked in Virginia and had Virginia taxes withheld from your paycheck in error, file Virginia Form 763-S — a special nonresident claim form — to get back the withholdings.
  • If you live in another state and have rental property and/or business income from Virginia, file Virginia Form 763, a nonresident tax return.
  • If you moved into or out of Virginia six months ago from another state, file Virginia Form 760PY, a Virginia part-year resident return.
  • If you’re retired and don’t have Virginia withholdings taken out of your retirement income and want the income covered for Virginia taxes, file Virginia Form 760ES — a Virginia estimated tax form — or contact the Virginia Department of Taxation at 804-367-8031.
  • Go to the Virginia Department of Taxation website to access most Virginia income tax forms.

The Commissioner of the Revenue is required to render taxpayer assistance in the preparing of any return required by law to be filed with this office. State Income Tax Returns and Estimated Tax Returns are processed and sent to the Department of Taxation.

The office of the Commissioner of the Revenue will complete your Virginia state income tax return at no charge. You must bring a completed copy of your federal return in order for the state return to be completed properly.

The office also audits all returns that come through the office to be forwarded to the Department of Taxation. This expedites the refund process as we also data entry the information directly into the computer system of the Department of Taxation.

Where's My Refund?

If you file your State Income Tax Return on paper in 2009 or future years, it will take longer to issue your refund. Returns filed electronically (E-file) will be processed at least 50 percent quicker than those returns filed on paper. It is considerably more costly to process a paper return than a return filed electronically, and due to the state’s current budget situation, TAX will no longer be able to process paper returns as quickly as we have in prior years.
